Niet-geregistreerde schenking: welk risicotermijn in elk gewest?
Wie het bewijs van een handgift, bankgift of onrechtstreekse schenking (bv. kwijtschelding schuld) niet laat registreren en dus geen schenkbelasting betaalt, moet als schenker wel nog een tijd in leven blijven om erfbelasting op de gedane schenking te vermijden.
In Vlaanderen gold vroeger een risicotermijn van drie jaar. De Vlaamse regering heeft die termijn verlengd tot vijf jaar voor schenkingen sinds 01.01.2025. Naast de risicotermijn van vijf jaar is er in Vlaanderen een risicotermijn van zeven jaar, maar die geldt alleen voor schenkingen van familiale ondernemingen, waarvan de schenking niet geregistreerd werd.
In het Brussels gewest is de risicotermijn nog altijd drie jaar. In het Waals gewest was de risicotermijn vroeger ook drie jaar, maar deze termijn van drie jaar werd sinds 01.01.2022 verlengd tot vijf jaar voor niet-geregistreerde schenkingen die plaatsvonden sinds 01.01.2022.
Het bevoegde gewest is het gewest waar de overledene (schenker) zijn woonplaats heeft. Is hij in de laatste vijf jaar verhuisd, dan kijkt men in welk gewest hij het langst gewoond heeft.
