Een rechter moest zich onlangs uitspreken in een zaak waarbij een belastingplichtige ervan uitging dat er eigenlijk een stilzwijgend akkoord was tot stand gekomen vermits de fiscus niets meer zich van liet horen nadat die belastingplichtige had geantwoord op zijn vraag om inlichtingen.
Een beroepsrechter te Gent volgde echter dat standpunt niet (Gent 19.09.2023). Het feit dat de fiscus niet (meer) reageert op dat antwoord, betekent niet dat de belastingplichtige er redelijk of rechtmatig op mag vertrouwen dat de fiscus akkoord gegaan is met zijn standpunt.
